A CHARTER ORDINANCE
EXEMPTING THE CITY OF WHITEWATER, KANSAS, FROM THE PROVISIONS OF K.S.A.
12-1304; K.S.A. 12-1901, 12-1902, 12-1903, 12-1904, 12-1905, 12-1906, 12-1907
and 12-1908; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT
RELATING TO THE RECREATION COMMISSION, THE APPOINTMENT OF MEMBERS THERETO,
TERMS OF OFFICE THEREFOR AND THE RECREATION COMMISSION’S POWERS.
Section 1. The City of Whitewater, Kansas, a third
class city, by the power vested in it by Article 12, Section 5 of the
Constitution of the State of Kansas hereby elects to exempt itself from and
makes inapplicable to it the provisions of K.S.A. 12-1304 and K.S.A. 12-1901,
12-1902, 12-1903, 12-1904, 12-1905, 12-1906, 12-1907, and 12-1908, and provide
substitute and additional provisions as hereinafter set forth in this
ordinance. Such referenced provisions are either enactments or parts thereof
which are applicable to this city but are not applicable uniformly to all
cities.
Section 2. There is hereby authorized a recreation
commission which shall consist of five members who shall be residents of the
City of Whitewater, Kansas. The mayor, with the approval of the city council of
the City of Whitewater, Kansas, shall appoint members to the commission as
follows:
Position No. 1 to
serve for a period of four years;
Position No. 2 to
serve for a period of four years;
Position No. 3 to
serve for a period of three years;
Position No. 4 to
serve for a period of two years;
Position No. 5 to
serve for a period of one year.
Section 3. Whenever a vacancy shall occur in the
membership of the recreation commission, a resident of Whitewater, Kansas,
shall be selected in the same manner as and for the unexpired term of the
member he or she is succeeding.
Section 4. The recreation commission shall elect a
presiding officer and secretary.
Section 5. The recreation commission is. hereby
empowered to administrate in all respects the business and affairs of the
recreation system of the City of Whitewater, Kansas. The powers set forth
herein include but are not limited to the power to expend funds for the
recreation system of the City of Whitewater, Kansas and to receive monies for
the purpose of carrying out the business and affairs of the City of Whitewater
recreation system to acquire equipment and maintain land, buildings or other
recreational facilities; to employ a superintendent of recreation and
assistants; to conduct the activities of the recreation system on any property
under its custody and management, or with proper consent, on any other public
property, and upon private property with the consent of the owners; and to
receive gifts from any source whatsoever.
