A CHARTER ORDINANCE REPEALING, MODIFYING AND CONSOLIDATING CHARTER ORDINANCE NO. 3 AND CHARTER ORDINANCE NO. 7 OF THE CITY OF WHITEWATER, KANSAS RELATING TO THE RECREATION COMMISSION, THE APPOINTMENT OF MEMEBRS THERETO, TERMS OF THE OFFICE THEREFOR AND THE RECREATION COMMISSIONER’S POWERS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WHITEWATER, KANSAS:
Section 1. The City of Whitewater, Kansas, a third class city, by the powers vested in it by Article 12, Section 5 of the Constitution of the State of Kansas hereby elects to exempt itself from and makes inapplicable to it the provisions of K.S.A. 12-1926(a); provides substitute and additional provisions as hereinafter set forth in this charter ordinance and amends Section 2 of Charter Ordinance No. 3. Such statutory referenced provisions are neither enactments or part thereof which are applicable to this city but are not applicable uniformly to all cities.
Section 2. The Recreation Commission of the City of Whitewater is hereby continued from its prior establishment thru Charter Ordinance No. 3.
Section 3. There is hereby authorized a seven member commission which shall consist of the following position terms and locations of residence:
Position 1 serves a four-year term and must be a City resident.
Position 2 serves a three-year term and must be a City resident.
Position 3 serves a two-year term and must be a City resident.
Position 4 serves a two-year term and must be a City resident.
Position 5 serves a four-year term and can be a City resident or a resident outside the City limits.
Position 6 serves a two-year term and can be a City resident or a resident outside the City limits.
Position 7 serves a three-year term and can be a City resident or a resident outside the City limits.
These members shall be voting members.
The seven voting members are allowed to appoint ex-officio, non-voting members to two year terms to assist with the discussion of mission of the recreation commission by a majority vote of the voting members. The ex-officio members shall not exceed five (5).
Section 4. Whenever a vacancy occurs in the membership of the recreation commission, the commission shall select a replacement member to serve the unexpired term and shall meet the residency requirements as outlined above.
Section 5. The recreation commission shall elect a president, vice president, treasurer and secretary.
Section 6. The recreation commission is hereby empowered to administrate in all respects the business and affairs of the recreation system of the City of Whitewater, Kanas and to receive monies for the purpose of carrying out the business and affairs of the City of Whitewater recreation system to acquire equipment and maintain land, buildings, or other recreational facilities; to employ a superintendent of recreation and assistants; to conduct the activities of the recreation system on any property under its custody and management, or with proper consent, on any other public property, and upon private property with the consent of the owners; and to receive gifts from any source whatsoever.
Section 7. Any charter ordinances or parts of charter ordinances of the City of Whitewater, Kansas in conflict with the above amendment are hereby repealed.
