ARTICLE 4. HOUSING AUTHORITY

8-401. Agent.

There is hereby created as an agent of the City of Andover, Kansas pursuant to K.S.A. 17-2337, et seq., an authority to be known as “The Housing Authority” of the City of Andover, Kansas and hereinafter to be called “The Authority.”

8-402. Authority.

The Authority so established in Section 8-401 hereinabove shall be comprised of five commissioners, all of whom shall be appointed by the Mayor of said City as soon as possible or practical after the first meeting in May, 1978, and thereafter terms of office shall expire commencing for one member at the first meeting of the Governing Body in May of 1979, for a second commissioner at the first council meeting in May, 1980, for a third commissioner the first council in May 1981, and the last two commissioners terms expiring at the first meeting in May, 1982, and thereafter each year commissioners shall be appointed as aforesaid for a term of office of four years.  All vacancies of unexpired terms shall be filled for the unexpired term by appointment of the Mayor.

A Commissioner shall receive no compensation for his or her services, but shall be entitled to the necessary expenses, including traveling expenses, incurred in the discharge of his or her duties. Each commissioner shall hold office until his or her successor has been appointed and has qualified.  A certificate of the appointment or reappointment of any Commissioner shall be filed with the Authority and this certificate shall be conclusive evidence of the due and proper appointment of the Commissioner.

8-403. Quorum.

Three Commissioners shall constitute a quorum of such Authority for the purpose of conducting business and exercising its powers and for all other purposes notwithstanding the existence of any vacancies.  Action may be taken by the Authority upon a vote of a majority of the Commissioners present, unless in any case the bylaws of the Authority shall require a larger number.  Meetings of the Commissioners of the Authority may be held anywhere within the perimeter boundaries of the area of operation of the Authority or within any additional area where the Authority is authorized to undertake a project.  The Commissioners of the Authority shall elect a Chairman, Vice-Chairman, Secretary and Treasurer among the Commissioners and shall adopt a set of bylaws.

8-404. Power.

The powers of said housing authority include the power to plan, develop, construct, maintain, operate and manage any housing project or projects of the City of Andover, Kansas and such other powers as the Governing Body of said City may designate by later ordinance and as authorized by K.S.A. 17-2337, et seq., and specifically such powers as may be delegated under K.S.A. 17-2340, but initially said Municipal Housing Authority shall have no power to encumber funds of said City, to authorize the expenditure of any money or the creation of any debt or the issuance of any bonds or other obligations.  It is the intention of the Governing Body that those powers enumerated by statute and particularly those involving the expenditure of any funds can only be exercised by said authority after the proper delegation of powers by subsequent ordinance or ordinance of the City.
