It shall be unlawful for any person to drink or consume any alcoholic liquor or beer in any public place (excepting such public places as may be duly licensed and authorized by said City of Andover, Kansas, to serve alcoholic liquor or beer for consumption on the premises of such place), or upon any meet right-of-way, alley or roadway within the City of Andover, Kansas.  Any person violating this section shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than Five Hundred Dollars ($500) and/or six months incarceration upon conviction of the same.

(a)   No Person under the legal age for consumption of alcoholic liquor or cereal malt beverage shall obtain or purchase, or attempt to obtain or purchase, alcoholic liquor or cereal malt beverage from any person except as authorized by law.

Violation of this subsection by a person 18 or more years of age but less than the legal age for consumption of alcoholic liquor or cereal malt beverage is a misdemeanor punishable by a fine of not more than $250.00 or by 40 hours of public service, or by both.

(b)   No person under the legal age for consumption of alcoholic liquor or cereal malt beverage shall possess or consume alcoholic liquor or cereal malt beverage except as authorized by law.

Violation of this subsection by a person 18 or more years of age but less than the legal age for consumption of alcoholic liquor or cereal malt beverage is a misdemeanor punishable:

(1)   By a fine of not more than $250.00 or by 40 hours of public service, or by both, if committed on the premises licensed to sell alcoholic liquor or cereal malt beverage pursuant to the appropriate article contained in the Kansas Statutes Annotated; or

(2)   By a fine of not more than $250.00 or by 10 hours of public service, or by both, if committed on any other premises.

(c)   This section shall not apply to the possession and consumption of cereal malt beverage by a person under the legal age for consumption of cereal malt beverage when such possession and consumption is permitted and supervised, and such beverage is furnished by, the person's parent or legal guardian.

(d)   All definitions of any terms used hereinabove in this ordinance shall be the same as those provided in the appropriate articles pertaining to cereal malt beverage and alcoholic liquor in Kansas Statutes Annotated.
