The Uniform Plumbing Code, 2006 Edition, including all appendix chapters is hereby incorporated by reference herein and made part of this Chapter and shall be Article 14 of the aforementioned Chapter of the Code of the City of Andover, Kansas, save and except for any portion as are hereinafter or may hereafter be deleted or amended, as authorized and in the manner prescribed by the provisions of K.S.A. 12-3010.

Those deletions, amendments or revisions to the 2006 Uniform Plumbing Code are as follows:
(a) Section 413.0 Plumbing Fixtures Required and the corresponding table. Table 2909.1 shall be deleted in their entirety.
(b) Section 1204.3.2 Final Piping Inspection is hereby deleted in its entirety.
(c) Appendix A is deleted.
(d) Appendix B is deleted.
(e) Appendix C is deleted.
(f) Appendix E is deleted.
(g) Appendix G is deleted.
(h) Appendix H is deleted.
(i) Appendix I is deleted.
(j) Appendix J is deleted.
(k) Appendix L is deleted.

The Uniform Plumbing Code, 2006, incorporated by reference in Section 4-1401 herein shall be amended as follows:
(a) SECTION 101.1 TITLE. These regulations shall be known as the Plumbing Code of the City of Andover, hereinafter referred to as the “plumbing code,” the “U.P.C.,” or “this code.”
(b) Section 102 is amended as follows:
(1) SECTION 102.2.2 RIGHT OF ENTRY. The Building Official shall have authority to enter upon premises at reasonable hours for the purpose of making inspections. Entry shall be made so as to cause the least possible inconvenience to any person in possession of the structure. If entry is denied, the Building Official may seek an order for this purpose from a court of competent jurisdiction.
(2) SECTION 102.3.2 VIOLATION PENALTIES. Persons who shall violate any provision of this code, or shall fail to comply with any of the requirements thereof, or who shall erect, install, alter or repair plumbing work in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than $500.00 (five hundred) dollars, or by imprisonment not exceeding 30 (thirty) days, or both such fine and imprisonment. Each day a violation continues after due notice has been served shall be deemed a separate offense.
(3) SECTION 102.3.3 PENALTIES RELATING TO STOP WORK ORDERS. Any person who shall continue any work after having been served with a stop work order, except such work as that person was directed to perform to remove a violation of unsafe condition, shall be liable for a fine of not less than $25 dollars and not more than $100 dollars. This fine shall be remitted prior to re-inspection.
(c) Section 103.4 is amended as follows:
103.4 FEE SCHEDULE. The fees for various permits and inspections shall be indicated in Article I of this Chapter of the Code of the City of Andover.
(d) SECTION 103.4.5.1 FEE REFUND. The Building Official shall authorize the refunding of fees as follows:
(1) The full amount of any fee paid hereunder which was erroneously paid or collected.
(2) Not more than 90% of the permit fee paid when no work has been done under a permit issued in accordance with this code.
(3) Not more than 90% of the plan review fees paid when an application for a permit for which a review fee was paid and is withdrawn or canceled. Plans re-submitted shall be subject to the full plan review fee.
(4) The Code Official shall not authorize the refund of any fees 180 days after the date fee is received.
(e) Section 313 relating to protection of piping is amended as follows:
(1) SECTION 313.9 PROTECTION AGAINST PHYSICAL DAMAGE. Protections against physical damage in concealed locations where piping, other than cast-iron or galvanized steel, is installed through holes or notches in studs, joist, rafters, plates or similar members less than 1.5 inches from the nearest edge of the member, the pipe shall be protected by shield plates. Protective shield plates shall be a minimum of 0.062-inch thick steel, and shall cover the area where the member is notched or bored.
(2) SECTION 313.10.1 SLEEVES. Sleeves shall be provided to protect all piping through concrete and masonry load bearing walls.
(f) Section 401 is amended as follows:
SECTION 401.1 QUALITY OF FIXTURES. Plumbing fixtures shall be constructed of dense, durable, non-absorbent materials and shall have smooth, impervious surfaces, free from unnecessary concealed fouling surfaces. Hot or tempered water shall be supplied to all plumbing fixtures and equipment utilized for culinary purposes, cleaning, laundry, and janitorial closets. Tempered water shall be supplied for hand-washing and bathing facilities.
(g) SECTION 404.2 CONNECTIONS is amended by adding the following:
Exception: Removing gypsum wallboard is permitted to allow for sufficient access.
(h) SECTION 603.3. GENERAL REQUIREMENTS is amended as follows:
(1) Section 603.3.8. In cold climate areas, backflow assemblies and devices may be protected from freezing with an outdoor enclosure or by a method acceptable to the Authority Having Jurisdiction.
(2) Section 603.4.6.1. Potable water supplies to systems having no pumps or connections for pumping equipment, and no chemical injection or provisions for chemical injection, shall be protected by one of the following devices:
(A) Pressure vacuum breaker
(B) Spill-resistant pressure vacuum breaker
(C) Reduced-pressure backflow preventer
(i) Section 712 relating is amended as follows:
SECTION 712.1 MEDIA. The piping of the plumbing, drainage, and venting systems shall be tested with water or air. The Authority Having Jurisdiction may require the removal of any cleanouts, etc., to ascertain whether the pressure has reached all parts of the system. After the plumbing fixtures have been set and their traps filled with water, they shall be submitted to a final test.
(j) Section 908 relating is amended as follows:
SECTION 908.4.1 BATHROOM WET VENTING. Where permitted. Any combination of fixtures within one (1) or two (2) bathrooms located on the same floor level may be permitted to be vented by a wet vent. The wet vent shall be considered the vent for the fixtures and shall extend from the connection of the dry vent along the direction of the flow in the drain pipe to the most downstream fixture drain connection to the horizontal branch drain. Only the fixtures within the bathroom(s) shall connect to the wet vented horizontal branch drain. Any additional fixtures shall discharge downstream of the wet vent system and be conventionally vented.

All prior ordinances of the City of Andover, Kansas in conflict with the forgoing are hereby repealed to the extent that such conflicts exist.

If any section, sub-section, sentence, clause or phrase of this ordinance or of the Code is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance and Code.

The City Clerk of the City of Andover, Kansas is hereby ordered and directed to maintain 3 copies of the Uniform Plumbing Code, 2006 Edition, on file in City Hall which copies shall be marked or stamped “Official copy as incorporated by Ordinance No. 1392” with all sections or portions thereof intended to be omitted clearly marked to show any such omission and to which shall be attached a copy of the incorporating Ordinance including all amendments and revisions adopted at the time of passage.
