ARTICLE 2. CITY HOSPITAL

12-201.      Hospital established.

There is hereby established in the city, a hospital which shall be known as Russell City Hospital, hereinafter referred to in this article as “Hospital.”

12-202.      Board of trustees.

The operation and management of the affairs of the hospital shall be vested in a board of trustees, consisting of five trustees, to be elected by the qualified voters of the city as hereinafter provided.

12-203.      Term, election, limitation.

The hospital trustees shall be elected at the regular city election held on the first Tuesday in April of each year, to serve for terms of three years each and the terms of the trustees shall be so arranged that the term of one trustee shall expire on one year and the term of two trustees shall expire in each of the next two succeeding years. Trustees shall be nominated and elected in the same manner as is provided by law for nomination and election of other elective officers of cities of the second class under the council-manager form of government. Each trustee shall take office at the organization meeting immediately following the election and unless sooner disqualified shall serve until his or her successor has been elected and qualified as provided by law.

12-204.      Eligibility.

The trustees provided for herein shall have been qualified electors of the city for at least two years immediately preceding the date of their election, and the removal of the residence of any trustee from the city shall constitute a forfeiture of office and create a vacancy therein. No physician, osteopath, chiropractor, nurse or other practitioner of the healing arts, or their spouses, who are on the staff of or associated with the Russell Regional Hospital shall be eligible to hold the office of hospital trustee. In the event any person who has been elected to the office of hospital trustee shall later be found to be ineligible, such ineligibility shall create an immediate vacancy which shall be filled in the manner as hereinafter set forth.

12-205.      Vacancies.

Vacancies on the board of trustees, by reason of removals, resignations, disqualifications or otherwise, shall be filled by appointment by the mayor with the approval of the council until the next regular city election, at which time a trustee shall be elected for the unexpired term.

12-206.      Organization.

Within 10 days after their election, the trustees shall organize a board of hospital trustees by the election of one of their number as chairperson, one as secretary, and one as treasurer.

12-207.      Compensation.

No trustee shall receive any compensation for his or her services, but the trustees may be reimbursed for actual expenses necessarily incurred by them in the performance of their duties.

12-208.      Meetings; records.

The board of trustees shall meet at least once each month and the secretary shall keep a full and complete record of its proceedings.

12-209.      Rules, regulations.

The board of trustees shall adopt such bylaws, rules and regulations for their own guidance and for the government, operation and use of the hospital as may be deemed necessary for the proper conduct and economical operation of the hospital which are not inconsistent with the laws of the State of Kansas or the ordinances of the city. The board of trustees may exclude from the use of the hospital any and all persons and practitioners who shall willfully violate the rules and regulations of the hospital.

12-210.      Hospital open to all.

Subject to the limitations set forth in section 12-209 of this article, the hospital shall be for the benefit of all inhabitants of the city, and of any person falling sick or being injured or maimed within its limits.

12-211.      Privileges extended.

Whenever such facilities are available, the board may extend the privileges and use of the hospital to persons residing outside of the city upon such terms and conditions as may be prescribed by its rules and regulations.

12-212.      Fees.

The board of trustees shall establish such rates for hospital room, nursing care, medicine, laboratory services and other services and accommodations as may be reasonable and necessary to pay all costs of operating and maintaining the hospital and facilities; and shall have authority to enter into contracts for such services and to maintain actions in the name of the hospital in all courts of this state and to take such other action as may be necessary, from time to time, to collect the accounts due the hospital and to conduct all affairs incident to the operation of the hospital.

12-213.      Treasurer; bonds; disbursements.

The treasurer shall be the custodian of all hospital funds, which shall be deposited in a responsible bank or banks. The board of trustees shall have the exclusive control of the disbursements of all hospital funds, which shall be paid out only upon verified claims, by checks or warrants signed by at least two members of the board.

12-214.      Supervision.

The board of trustees shall have the exclusive control of the buildings, grounds and all other property belonging to the hospital. They shall have the exclusive right to operate and manage the hospital and to hire such supervisory and other employees as may be necessary for such purpose and to fix their compensation.

12-215.      Control of persons, property.

All physicians, nurses, attendants, patients, employees and all other persons coming within the hospital and all personal property used or brought into the hospital shall be subject to such rules and regulations as the board may prescribe.

12-216.      Inspections.

The trustees shall visit and inspect the hospital at least once each month.

12-217.      Annual report.

The board of trustees shall on or before the 15th of July of each year file with the governing body an itemized report of all receipts and disbursements for the preceding year, together with a statement of the actual and estimated receipts and disbursements for the current year; and an itemized budget of estimated receipts and disbursements for the ensuing year; and shall in addition thereto, at such time, present to the governing body an estimate of the amount necessary to maintain, equip and improve the hospital for the ensuing year over and above the amount of the estimated receipts from all sources.

12-218.      Licensed practitioner.

In the management and operation of the hospital, no discrimination shall be made against any practitioner of the healing arts who is currently licensed under the laws of the State of Kansas, and all such licensed practitioners shall have equal privileges in the treating of patients in the hospital within the limits of· their respective licenses. Any patient shall have the absolute right to employ, at his or her own expense, a licensed practitioner of his or her own choosing; and such practitioner when so employed by a patient shall have exclusive charge of the care and treatment of the patient; and the nurses shall, as to such patient, be subject to the direction of such practitioner, subject to the limitations contained in his or her license and subject also to the general rules and regulations which may be established by the board of trustees under the provisions of this article.
