ARTICLE 1. STANDARD TRAFFIC ORDINANCE

17-101.      Incorporating standard traffic ordinance.

There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Russell, Kansas, that certain standard traffic ordinance known as the “Standard Traffic Ordinance for Kansas Cities,” Edition of 2010, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, save and except such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed. No fewer than three (3) copies of the Standard Traffic Ordinance (STO) shall be marked or stamped “Official Copy as Adopted by Ordinance No. 1818”, with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or changes and to which shall be attached a copy of this ordinance, and filed with the city clerk to be open to inspection and available to the public at all reasonable hours. The Police Department, Municipal Judge and all administrative departments of the city charged with enforcement of the ordinance shall be supplied, at the cost of the city, such number of official copies of the Standard Traffic Ordinance similarly marked, as may be deemed expedient.

17-102.      Amendments and additions to standard traffic ordinance.

(a)      That Paragraph (a) of Section 33 of the STO on Maximum Speed Limits is amended to contain an additional provision as follows:

(6)          On those streets specifically set forth in Ordinances No. 1486, 1574, 1722 and 1730, the speed limits set forth therein.

(b)     That Sub-paragraph (b) of Section 85 of the STO for Kansas Cities is hereby amended to add the following

(7)          Within 30 feet of any intersection.

(c)      That Sub-paragraph (c) of Section 114.1 of the STO is hereby amended to read as follows:

(c)          No All-Terrain Vehicle shall be operated within the corporate limits of the City of Russell between sunset and sunrise except for such vehicle as is being used by a law enforcement officer for law enforcement purposes or is being used in a parade authorized by the governing body of the City.

(d)     That Section 142 of the STO concerning equipment for motorcycle operator or rider is amended to add an additional provision as follows:

(e)          Notwithstanding any other provisions set forth in the STO for purpose of this Section 142 an All-Terrain Vehicle shall be deemed to be a motorcycle.

(e)      That Subparagraph (e) of Section 182.1 of the STO is hereby amended to read as follows:

(e)(1)      Persons violating Subsection (a) shall be fined $30.00 inc1uding court costs;

(e)(2)      Persons violating Subsection (b) shall be fined $60.00 inc1uding court costs;

(f)      That Section 200 of the STO on Motor Vehicle Liability Insurance is amended to add an additional provision as follows:

(g)          For purposes of this Section 200 an All-Terrain Vehicle (ATV) shall not be exempt from the Kansas Automobile Injury Reparations Act and such ATV will be insured and proof of insurance maintained as set forth herein.

17-103.      Deletion from standard traffic ordinance.

Section 114.4 concerning operation of a golf cart and Section 175.1 concerning Compression Release Engine Braking System are deleted.

17-104.      Traffic infractions and traffic offenses.

(a)      An ordinance traffic infraction is a violation of any section of this ordinance that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as traffic infraction in K.S.A. 8-2118.

(b)     All traffic violations which are included within this ordinance, and which are not ordinance traffic infractions as defined in subsection (a) of this section, shall be considered traffic offenses.

17-105.      Penalty for scheduled fines.

The fine for violation of an ordinance traffic infraction or any other traffic offense for which the Municipal Judge establishes a fine in a fine schedule shall not be less than $10.00 nor more than $2,500.00. A person tried and convicted for violation of an ordinance traffic infraction or other traffic offense for which a fine has been established in a schedule of fines shall pay a fine fixed by the Court, not to exceed $2,500.00.
