A CHARTER ORDINANCE EXEMPTING THE CITY OF FLORENCE, KANSAS, FROM THE PROVISIONS OF THE LAST PARAGRAPH OF K.S.A. 1971 SUPP. 14-103 AND ALL OF K.S.A. 1971 SUPP. 14-201, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS OF THE SAME SUBJECT, RELATING TO THE ELECTION AND APPOINTMENT OF CITY OFFICERS AND THE TERMS OF OFFICES.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FLORENCE, KANSAS:
SECTION 1. The City
of Florence, Kansas, by the power vested in it by Article 12, Section 5, of the
Constitution of the State of Kansas, hereby elects to exempt itself from and
make inapplicable to it the provisions of the last paragraph of K.S.A. 1971
Supp. 14-103 and all of K.S.A. 1971 Supp. 14-201 and provide substitute and
additional provisions as hereinafter set forth in this ordinance. Such
reference provisions are either enactments or a part thereof which are
applicable to this City but are not applicable uniformly to all cities.
SECTION 2. There
shall be elected on the first Tuesday in April of each odd-numbered year a
mayor and, except as otherwise provided herein, one-half the number of
councilmen in the manner hereinafter set forth in this section. The mayor shall
hold this office for a term of two (2) years or until his successor is
qualified. There shall be two (2) councilmen elected from each ward within the
city and, except as otherwise provided herein, they shall hold their offices
for a term of four (4) years or until their successors are qualified. Commencing
at the next election held in an odd-numbered year and for that election only,
two (2) councilmen shall be elected from each ward with the councilman
receiving the highest number of votes in each ward elected to a four (4) year
term and the councilman receiving the second highest number of votes in each
ward elected to a two (2) year term. Thereafter, all councilmen shall be
elected to four (4) year terms consistent with the provisions of this section.
SECTION 3. The mayor
shall appoint, by and with the consent of the council, a municipal judge of the
municipal court, a city marshal-chief of police, city clerk, city treasurer,
city attorney, and may appoint policemen and such other officers as deemed
necessary. Officers so appointed and confirmed shall hold their offices for a
term of one (1) year or until their successors are appointed and qualified. The
council shall by ordinance specify their duties and compensation, and by
ordinance may abolish any office created by them whenever they may deem it
expedient. The council may retain a licensed professional engineer to act in
the capacity of city engineer for specifically defined duties and provide for
reasonable compensation for services rendered.
