CHAPTER XIV. TRAFFICCHAPTER XIV. TRAFFIC\Article 1. Standard Traffic Ordinance

(a)   There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Council Grove, Kansas, within the Council Grove Lake Park, that certain standard traffic ordinance known as the “Standard Traffic Ordinance for Kansas Cities,” 51st Edition for 2024, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas. No fewer than three copies of said Standard Traffic Ordinance shall be stamped “Official Copy as Adopted by Ordinance No. 2272,” and to which shall be attached a copy of this article or said ordinance, and filed with the city clerk to be open to inspection and available to the public at all reasonable hours. The police department, municipal judge and all administrative departments of the city charged with enforcement of the ordinance shall be supplied, at the cost of the city, such number of official copies of such Standard Traffic Ordinance similarly marked, as may be deemed expedient.

(b)   Section 114.1, 114.2 and 114.4 of the Standard Traffic Ordinance is hereby omitted and deleted

Article 6 relating to and headed “Serious Traffic Offenses” of said Standard Traffic ordinance is hereby amended and enlarged to include Section 29a, as follows:

Section 29a. Inattentive. Negligent or Unsafe Driving.

(a)   Every driver shall remain alert and give full attention to the safe operation of his vehicle while it is in motion, and any driver who does not, shall be in violation of this section.

(b)   No driver while driving shall engage in any activity or do any act which interferes with the safe control of his or her vehicle.

(c)   No person shall operate or halt any vehicle in such manner as to indicate a careless or heedless disregard for the rights or the safety of others, or in such manner as to endanger, or be likely to endanger, any person or property. Any person violating the provisions of this section shall be deemed guilty of unsafe, inattentive or negligent driving and in violation of this action.

(a)   An ordinance traffic infraction is a violation of any section of this article that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. Supp. 8-2118.

(b)   All traffic violations which are included within this article, and which are not an ordinance traffic infraction, as defined in subsection (a) of this section, shall be considered traffic offenses.

The fines for violation of an ordinance traffic infraction or any other traffic offense for which the municipal judge establishes a fine in a fine schedule shall be set forth in that fine schedule. Otherwise it shall not be less than $50.00 nor more than $500.00.
