There is hereby established the Recreation Commission of the City of Council Grove, Kansas, as authorized by Chapter 12, Article 19 of the Kansas Statutes Annotated and amendments thereto.

The recreation commission shall cause to be inaugurated and conducted a recreation program in the city and shall have full and complete authority and supervision over such recreation program.

The recreation commission shall consist of five members to be appointed as follows: The governing body shall appoint four members, the first appointee shall serve for four years, the second for three years and the third for two years and the fourth for one year. A fifth member who shall also serve for four years shall be appointed by the four appointee members of such commission. Thereafter, the members of said commission shall be selected in the same manner as the member he is succeeding and the term of each shall be four years, except in case of an appointment to fill a vacancy in an unexpired term.

The members of the recreation commission shall annually elect one of its members to serve as the presiding officer to be known as the chairperson, one as vice-chairperson and one to serve as secretary. Officers shall serve for one year or until their successors have been selected by the commission.

All members and officers of the recreation commission shall serve without pay; provided, that such officers shall be reimbursed for any expenditure made for the benefit of the recreation program.

(a) REGULAR MEETINGS. The Council Grove Recreation Commission shall have regularly scheduled meetings on the third Sunday of each month beginning at 6:30 p.m. at City Hall, in Council Grove, Kansas. Any business of the commission may be discussed at regular meetings.
(b) SPECIAL MEETINGS. The Council Grove Recreation Commission may schedule special meetings, but at those meetings shall conduct only business which is placed upon the agenda after adequate notice to the public.

The recreation commission shall have the right to use, occupy and derive the benefits of any public or private property with the consent of the owner or legal authorities having charge thereof, which can be made a part of or utilized in the conduct of the city recreation program.

The recreation commission may employ a recreation director, who shall be directly responsible for the recreation commission and receive such compensation as may be fixed by the recreation commission. The commission may employ such other personnel for such compensation as the commission shall deem fit and proper.

Within 60 days after the close of each calendar year, the recreation director shall make an annual report to the recreation commission. The report shall contain such data as may be required by the recreation commission.

All money received from taxation, gift or otherwise for the use and benefit of the recreation program shall be kept by the city treasurer in a separate fund known and designated as the recreation fund and the city treasurer shall be ex-officio treasurer of such fund.

(a) The recreation commission shall annually and not later than 20 days prior to the date for the publishing of the budget of the city file with the city clerk:
(1) An annual report showing the activities and extent of the program conducted by the recreation commission during preceding calendar year; and such report shall include a detailed statement of the amounts of all moneys received from every source and all property rights or privileges granted or extended for the use and benefit of the recreation program during the preceding calendar year; and
(2) A proposed budget of expenditures and anticipated costs of the operation, maintenance and improvement of the recreation program for the people of the city during the calendar year immediately following.
(b) The report and budget herein required shall be in writing and signed by the chairman and secretary of the recreation commission. The city shall not budget for the recreation fund an amount greater than that shown in the proposed budget of the recreation commission.

All claims or demands of every kind and nature against the moneys of the recreation fund shall be made upon a verified claim voucher signed by the claimant or on behalf of said claimant, which shall be first presented to the recreation commission and if approved by such commission, the chairman of the recreation commission or, in his absence or incapacity, the vice chairman shall place the approval of the commission thereon and deliver the same to the city treasurer, who shall pay the same.
