A CHARTER ORDINANCE EXEMPTING THE CITY OF CHASE, KANSAS, A MUNICIPAL CORPORATION OF THE THIRD CLASS, FROM THE PROVISIONS OF K.S.A. 12-4112, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO THE ASSESSMENT OF COSTS IN THE MUNICIPAL COURT AND AMENDING CHARTER ORDINANCE NO. 312 OF THE CITY OF CHASE, KANSAS.
Section 1. The City of Chase, Kansas, a municipal corporation of the second class, by virtue of the power invested in it by Article 12, Section 5, of the constitution of the State of Kansas, hereby elects to exempt itself and hereby exempts itself from the provisions of K.S.A. 12-4112 inasmuch as said statute prohibits the collection of costs of the administration of justice in municipal courts. The remaining portion of K.S.A. 12-4112, inasmuch as it allows for the collection of witness fees and mileage, shall not be affected by the passage of this ordinance.
Section 2. Court Costs. There shall be a $30 assessment taxed to each case filed in the municipal court of the City of Chase, Kansas, payable by the defendant if convicted, in K.S.A. 12-4411. Said assessment shall be designated as court costs and shall be in addition to any fine or order of restitution as may be imposed by the municipal judge.
